1. Agreement to these terms
These Terms of Service apply when you visit the Momentures website, create or use a customer account, request a resource, or buy a Momentures product. Momentures is the legal seller. By using the website or completing a purchase, you agree to these terms and any product-specific terms shown before purchase.
Please also read the Privacy Policy and Returns & Refunds Policy. If you do not agree to these terms, do not use a customer account or complete a purchase.
2. Adult use and information about children
The website, forms, accounts, marketing signup, and purchases are for adults who can enter into the relevant agreement. Momentures does not request or intentionally store identifiable information about a child. Do not submit a child's name, photograph, medical or developmental details, school information, precise location, or other information that identifies a child.
3. International availability
Digital products may be available internationally. Availability depends on local law, sanctions and trade restrictions, the payment options shown at checkout, tax handling, and any restriction stated for a particular product. A product's appearance on the website does not guarantee that it can lawfully or practically be supplied in every location.
Physical delivery is limited as described in the Delivery Policy.
4. Orders, prices, and taxes
Prices are shown in United States dollars unless the checkout clearly states otherwise. Your payment provider may apply currency conversion, fees, or holds under its own terms. You are responsible for reviewing the product, price, billing country, and contact information before placing an order.
Taxes are calculated or collected where applicable. The final checkout total and the order confirmation are the transaction record for the items, discounts, tax, delivery charge, and total accepted at purchase. If a clear pricing or product-description error affects an order, Momentures may contact you to offer correction or cancellation, subject to applicable law.
5. Payment
The payment methods displayed during checkout are the methods available for that transaction. Payment is handled through hosted checkout by the provider identified there. By submitting an order, you authorize the displayed charge and confirm that you are permitted to use the chosen payment method.
Do not send complete payment-card details, account passwords, or other payment credentials by email or through a general Momentures form. If payment is declined, reversed, or placed on hold, access or fulfillment may wait until the payment provider confirms the transaction.
6. Digital delivery
Purchased digital products are delivered through SureCart customer access and protected downloads. You are responsible for providing an accurate adult email address and for keeping account and download access secure. Contact info@momentures.com if an order is confirmed but access is missing or a file cannot be opened.
For customers in the European Union, European Economic Area, or United Kingdom, immediate access may require a separate express consent and acknowledgment at checkout. That acknowledgment does not remove rights for faulty, inaccessible, or misdescribed content and does not remove the Momentures refund promise for accidental or duplicate purchases.
7. Household license
When you purchase a Momentures script, guide, workbook, card set, printable, or similar digital resource, Momentures grants you a personal, limited, non-exclusive, non-transferable, and non-sublicensable license to use it in the purchasing household, subject to these terms and any product-specific terms.
When the product description permits printing, you may make reasonable copies for use within the purchasing household and by caregivers directly supporting that household. The purchase does not grant an organizational, professional-practice, classroom, library, group-program, or site-wide license.
8. Prohibited redistribution and use
Unless Momentures gives prior written permission or a separate license expressly allows it, you must not:
- sell, sublicense, redistribute, lend, or give the resource or its files to another household or organization;
- upload the resource to a public website, shared drive, social platform, marketplace, file-sharing service, classroom system, or organizational library;
- share customer, download, or account credentials;
- remove or obscure copyright, trademark, attribution, or ownership notices;
- copy or adapt a resource for resale or for delivery as your own professional, classroom, or commercial material; or
- use a resource or its contents to train, populate, benchmark, or create a competing commercial product or service.
Reasonable household and caregiver copies allowed under the household license are not prohibited redistribution.
9. Educational and practical boundary
Momentures resources provide educational and practical parenting support. They do not diagnose, treat, prescribe, or replace medical, psychological, psychiatric, therapeutic, developmental, legal, or emergency care. They do not create a clinician-patient, therapist-client, attorney-client, or other professional relationship.
Every family and situation is different. Use your judgment and seek a qualified professional when you need individualized assessment or advice. If you are concerned about immediate danger, abuse, a medical emergency, or a risk of harm, contact the appropriate emergency or safeguarding service in your location rather than relying on a Momentures resource.
10. Third-party services and links
The website may rely on or link to third-party services for checkout, payment, customer access, email, fulfillment, analytics choices, or external information. Their own terms and privacy notices may apply to the activities they control. A link is provided for convenience and does not by itself mean that Momentures controls or endorses the linked service or all of its content.
11. Intellectual property
The website, branding, text, graphics, downloads, and other Momentures materials are owned by Momentures or used with permission and are protected by applicable intellectual-property laws. Your purchase gives you only the limited household license described above. No other ownership or license is transferred.
If you believe material on the website infringes your rights, contact info@momentures.com with enough information for us to understand and locate the material.
12. Returns and refunds
Returns, refunds, digital remedies, and access revocation are governed by the Returns & Refunds Policy. Accidental and duplicate digital purchases are refundable under that policy. Faulty, inaccessible, incomplete, corrupted, or materially misdescribed digital content may qualify for repair, replacement, restored access, or refund as appropriate.
When a digital refund is approved, the refund is sent to the original payment method and access to the refunded product is revoked. Nothing in these terms limits mandatory consumer rights or statutory remedies that apply to you.
13. Availability and changes to services
Momentures works to keep the website, customer access, and downloads available, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, security concerns, provider outages, legal restrictions, or events outside reasonable control can affect availability. We may change or discontinue a free feature or future product offering, but we will not use that change to remove a remedy or access right that applicable law requires for an existing purchase.
14. Disclaimers
To the extent permitted by law, the website and educational resources are provided as described and otherwise on an "as available" basis. Momentures does not promise a particular parenting, health, educational, relationship, or financial outcome. Examples are illustrative and may not fit every family.
These disclaimers do not exclude an express product description, the remedies stated in the Returns & Refunds Policy, or any warranty, guarantee, or other right that cannot lawfully be excluded.
15. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law so provides.
Subject to that rule and to mandatory consumer rights, Momentures is not responsible for indirect or unforeseeable loss caused by use of the website or resources, a customer's failure to follow reasonable security instructions, or a third-party service outside Momentures' reasonable control. Any limitation is applied only to the extent permitted by the law that applies to you.
16. Indemnity
To the extent permitted by law, you agree to reimburse Momentures for direct, reasonable losses and costs resulting from your deliberate or material breach of the household license, prohibited-use rules, or another person's intellectual-property rights. This section does not apply to lawful consumer use, does not require payment for a loss caused by Momentures, and does not limit any mandatory consumer protection available to you.
17. Suspension and termination
You may stop using the website at any time. Momentures may suspend or terminate access when reasonably necessary to address nonpayment, fraud, a security threat, unlawful conduct, credential sharing, or a material breach of these terms. Where appropriate, we will give notice and a reasonable opportunity to correct the issue.
Termination does not erase payment obligations already incurred, intellectual-property protections, refund rights, mandatory consumer rights, or provisions that by their nature continue after access ends. An approved refund may revoke access to the refunded digital product as described in the Returns & Refunds Policy.
18. Governing law and mandatory rights
North Carolina law governs these terms where permitted by law, without applying rules that would select another jurisdiction's law. This choice does not remove mandatory consumer protections or a mandatory court or dispute forum available under the law of the country or region where you live. If a provision conflicts with a right that cannot legally be waived, that mandatory right controls to the extent of the conflict.
Before starting a formal dispute, you and Momentures are encouraged to contact each other and try in good faith to resolve the concern. This does not shorten a legal deadline or require you to give up a forum or remedy that law preserves.
19. Changes to these terms
Momentures may update these terms when services, products, or legal duties change. The revised terms will show a new revision date. Changes apply prospectively unless applicable law permits otherwise and appropriate notice is provided. The terms accepted for a completed order and mandatory rights that apply to it are not removed merely because the website terms later change.
